Texas Court Appeal Against Union Pacific

TEXAS APPEALS COURT ORDERS CASE AGAINST UNION PACIFIC MUST BE ALLOWED TO PROCEED; FAMILY OF BABY KILLED IN COLLISION WITH TRAIN WILL HAVE THEIR DAY IN COURT.

Justice was served in a Texas appeals court today.

In a Memorandum Opinion handed down earlier today by a unanimous panel of the 13th District of Texas Court of Appeals, a decision of the Cameron County, Texas district court dismissing a lawsuit brought by Viviana and Jesse Sosa against the Union Pacific Railroad Company was reversed and sent back to the trial court to give the Sosas their day in court.

On January 23, 2007, a Union Pacific train collided with the car Viviana Sosa was riding in, killing the baby she was carrying and badly injuring Viviana. The rural crossing had no formal crossing signal and the Sosas never saw or heard the train coming before it hit their car.
